Tripate Terms & Conditions

Please read these terms and conditions carefully before using our services.

1. Acceptance of Terms

By accessing or using the Tripate.com website and services, you agree to be bound by these Terms and Conditions (“T&C”). Taabow Travels Private Limited (“Company”) provides its visa facilitation and tour booking services subject to your compliance with these T&C. If you do not agree with any part of these T&C, you must refrain from using this website or our services. Continuing to use our site indicates your acceptance of these terms.

2. Scope of Services

  • 2.1 Visa Facilitation: The Company acts only as an intermediary to assist Indian customers in applying for visas to various countries. We lodge visa applications on your behalf with the relevant embassies/consulates, but we do not have authority to grant or refuse a visa. Our service is limited to providing information (such as document checklists and processing times) and submitting applications as per the requirements of the embassy/consulate. The decision to approve or deny a visa is made solely by the government authorities of the destination country, and we have no control over or influence on that outcome.
  • 2.2 Tour Booking: The Company offers tour packages (domestic and international) which may include travel arrangements such as transportation, accommodation, sightseeing, and other services. For components of travel not directly operated by us (e.g. flights, hotels, transport provided by third parties), we act only as an agent facilitating your bookings with those independent service providers. Our obligation is limited to arranging and reserving the tour services; the ultimate contract for third-party services (airline, hotel, etc.) is between you and the respective provider. We may also organize and operate our own tours, in which case we remain responsible for delivering the tour itinerary to the best of our ability, subject to these T&C and applicable law.
  • 2.3 Eligibility: Our services are available only to Indian citizens or residents who are 18 years of age or older and legally capable of entering into binding contracts. By using Tripate.com, you represent that you meet these eligibility criteria. We reserve the right to refuse service, cancel accounts, or cancel bookings if we believe a user is not eligible or has provided false information.

3. User Accounts and Information

3.1 Account Registration: You may need to create an account on Tripate.com to use certain services. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. If you become aware of any unauthorized use of your account, you must notify us immediately. The Company will not be liable for losses arising from unauthorized access due to your failure to secure your credentials.

3.2 Accurate Information: You agree to provide true, accurate, current, and complete information when registering or booking services. For visa applications, you must furnish all required personal details and documentation as per the visa checklist provided. It is your responsibility to ensure that all information and documents submitted are authentic and error-free. We do not independently verify the accuracy or genuineness of documents you provide and rely entirely on you for correctness. Incomplete, incorrect, or fraudulent information/documentation can lead to delays, additional costs, or rejection by authorities, for which we bear no responsibility. The Company reserves the right to refuse or halt processing of any application or booking if the information provided is suspected to be false, incomplete, or does not meet our or the authorities’ requirements.

3.3 Personal Use of Site: Tripate.com is made available for your personal, non-commercial use only. You agree not to modify, copy, distribute, transmit, reproduce, publish, license, or sell any content, information, or services obtained from this website for any commercial purpose. Scraping the website or using it for unauthorized commercial purposes (such as reselling bookings without permission) is prohibited. We reserve the right to cancel any orders or accounts that violate this condition and take appropriate legal action if necessary.

3.4 Prohibited Activities: You agree not to use Tripate.com for any purpose that is unlawful or prohibited by these T&C. This includes (but is not limited to) not engaging in any fraudulent bookings, not using the site to transmit harmful code, not interfering with other users’ use of the site, and not circumventing the security or content usage rules of the site. We reserve the right to terminate or restrict access to any user engaging in prohibited conduct without notice.

4. Booking Process and Payments

  • 4.1 Online Booking Requests: When you submit a booking request (for a visa service or a tour), it is an offer to avail our services. We will process your request and confirm availability and prices of the requested service before binding confirmation. A booking (whether visa processing or tour package) is only confirmed when we send you an explicit confirmation indicating the price and availability of service and you make the required payment. Any preliminary communications or auto-generated booking numbers prior to our confirmation are merely acknowledgments of request, not a confirmed service commitment. We reserve the right to accept or reject any booking requests at our sole discretion, including cases where requisite information is incomplete or payment is not received.
  • 4.2 Pricing and Fees: You agree to pay all charges for the services you book through our site, including visa fees, tour package prices, service fees, taxes, and any additional charges applicable. The Company charges a service fee for visa processing in addition to the embassy visa fee and other third-party charges. All fees are communicated to you prior to final booking confirmation. We reserve the right to change our service fees or institute new fees at any time, and such changes will be updated in these T&C or communicated before you make a booking.
  • 4.3 Price Changes & Errors: Visa fees, embassy charges, fuel surcharges, taxes or other components of price not under our control are subject to change without prior notice, as determined by the respective authorities or suppliers. If any such amounts change before your booking is completed or your visa is submitted, you will be liable to pay the difference for your booking to proceed. In rare cases where a technical error or other issue causes an incorrect price to be displayed or charged, we reserve the right to correct the price. In case of underpayment due to error, we will inform you of the additional amount due and you agree to pay the difference; if you do not, we may cancel the booking. Any increase in taxes or introduction of new taxes/levies by government authorities (including retrospective changes) will be passed on to you, and you agree to bear such charges as applicable.
  • 4.4 Payment Terms: Payments must be made in Indian Rupees (INR) using the payment methods we support. Your credit/debit card or other payment instrument will be charged at the time of booking confirmation. You are responsible for any bank charges or payment gateway fees. In the event a booked service cannot be confirmed by us (e.g., due to unavailability), our liability is limited to refunding any amount you have paid for that unconfirmed booking. We are not obliged to provide alternative arrangements as a consequence of an unconfirmed booking. Refunds for cancellations (whether initiated by you, by a supplier, or due to force majeure) will be handled as per our Cancellation/Refund Policy and the supplier’s terms, and may be subject to fees (see Section 8 below).
  • 4.5 Communications: You consent to receive communications (calls, SMS, emails) from the Company regarding your account, bookings, and services. This consent overrides any Do-Not-Disturb/Do-Not-Call registrations you may have, as it is essential for us to contact you about service updates or information related to your travel.

5. User Responsibilities and Obligations

You, the user, agree to the following obligations:

  • Provide Required Documents: You will timely provide all documents and information necessary for your visa application or tour booking. This includes (but is not limited to) passport copies, photographs, completed forms, proof of travel arrangements, financial statements, invitation letters, or any documentation listed in our checklist or requested by the embassy/consulate. If you fail to provide required documents by the deadlines given, we may be unable to process your visa or booking, and you will not hold us liable for any resulting delays or losses.
  • Ensure Document Authenticity & Accuracy: You confirm that all documents (e.g. passport, IDs, certificates) and information you submit are genuine, accurate, and up-to-date. Submission of false, fraudulent, or misleading documents/information is a serious offense and can lead to visa rejection, blacklisting by authorities, and termination of services without refund. We bear no responsibility for verifying the authenticity of documents; any consequences of falsified or incorrect documentation rest solely with you.
  • Passport & Visa (Travel) Validity: For tour bookings, you must possess a valid passport (with at least 6 months validity beyond the travel dates) and obtain all necessary visas or transit visas for your trip. While we may assist in advising visa requirements, ensuring that you meet entry requirements of your destinations (including transit countries) is your responsibility. The Company bears no obligation for your visa or immigration compliance; you must check and fulfill the latest requirements before travel.
  • Review Booking Details: Upon receiving any visa or tour booking confirmation, you will review all details (such as personal information on visas, itinerary, dates, prices, passenger names) immediately. In case of any discrepancy or error, you must inform us within of receipt so that we can attempt to address it. We will not be responsible for any loss, damage, or inconvenience resulting from errors that are reported late (beyond the 24-hour window) or not reported at all.
  • Comply with Laws and Instructions: You agree to follow all rules, laws, and regulations applicable to your use of our services and to your travel. This includes immigration laws, customs regulations, foreign exchange rules, and any specific instructions given by us or by service providers (airlines, hotels, tour guides, etc.). If you are on a tour, you must adhere to the tour guidelines, schedule, and act in a manner that is safe, lawful, and respectful to others. We reserve the right to remove from a tour any participant who, in our opinion, is behaving in a manner that endangers themselves or others or violates local laws, without any refund.
  • Travel Insurance Recommendation: We strongly recommend that you purchase comprehensive travel insurance for your trip to cover unforeseen events such as medical emergencies, trip cancellation, loss of baggage, etc. While not mandatory, it is for your own protection and peace of mind. Note that our liability in such situations is limited (see Section 7), and having insurance will help mitigate your risks.

6. Visa Processing Specific Terms

The following terms apply specifically to our visa application facilitation services:

  • 6.1 No Guarantee of Visa Issuance: The Company acts solely as a facilitator for visa processing and does not guarantee that a visa will be granted. Issuance or rejection of visas is at the sole discretion of the respective country’s Embassy/High Commission, which may require additional information or an in-person interview, or refuse visas without providing reasons. We are not responsible for the outcome of your application and cannot influence the visa decision in any way. Even if we have successfully assisted other applicants, each application is evaluated by the authorities on its own merits.
  • 6.2 Processing Times: Any visa processing times provided on our site or by our agents are approximate and based on general guidelines or past experience. Processing can be delayed due to various factors outside our control, such as backlogs at the embassy, additional document requests, security clearances, or changes in government procedures. We will not be liable for delays in visa processing or any consequences of such delays (e.g. missed flights). We advise applying well in advance of your travel date and refraining from finalizing travel plans until you obtain your visa.
  • 6.3 Embassy Fees and Changes: Visa fees and embassy charges are set by foreign governments and are subject to change at any time. We will inform you of the current fee at the time of application. If the embassy updates fees or requirements unexpectedly (including after submission), you agree to pay any additional fees or provide additional documents needed. Embassy and VFS (Visa Facilitation Service, if applicable) fees are non-refundable once the application is processed, regardless of the visa outcome.
  • 6.4 No Refund After Submission: Our service fee is non-refundable once we have started processing your visa request and a Booking/Application ID is generated. If you cancel a visa request after we have already submitted your documents to the embassy, no refund of the visa fee or service fee will be possible. If you withdraw your application before submission to the embassy, you may be eligible for a partial refund of government fees (subject to our Cancellation Policy and at our discretion). The refund of any embassy fee (if applicable) will follow the specific embassy’s refund rules, which typically do not allow refunds after processing has begun.
  • 6.5 Facilitator Role & Applicant’s Responsibility: We provide a checklist of required documents and may review your application for completeness, but we do not provide visa or legal advice on the likelihood of approval. Preparing a complete application is your responsibility. We do not guarantee that the documentation you submit is sufficient for visa issuance; the embassy may at any time request additional documents or information. If an embassy requires you to appear for an interview or provide biometrics, you must comply at your own cost – our role is limited to notifying you of such requirements when we are informed. Failure to attend an embassy appointment or provide additional information in time may result in denial of the visa, for which we are not responsible.
  • 6.6 Passport Handling and Courier: In cases where a physical passport submission is required, we will take due care to handle your passport securely. After visa processing, we will arrange to return your passport to you by courier or in-person collection as per our procedures. Courier Service: If we send or receive documents via third-party courier services, the risk of loss or delay passes to you upon handing over to the courier. We use reputable courier partners, but we are not liable for any loss, damage, or delay caused by courier mishandling or circumstances during transit. We strongly encourage you to track your shipment and ensure someone is available at the delivery address. In the unlikely event your passport is lost or damaged in transit, our liability will be limited to the amount of insurance coverage (if any) provided by the courier.
  • 6.7 Post-Visa Issuance Check: Upon receiving your passport with an affixed visa, you must verify that the visa details (such as your name, passport number, visa validity dates, and number of entries) are correct and match your travel plans. If you find any discrepancy, notify us immediately (within 24 hours as noted in Section 5) so we can assist in rectification if possible. The Company is not responsible for any consequences (e.g. denial of entry) arising from errors in visa documents if those errors were present on the visa issued by the foreign authority and you did not alert us promptly.
  • 6.8 No Liability for Entry Denial: A visa granted by a foreign embassy/consulate does not guarantee entry into that country. Final admission is determined by immigration officers at the point of entry. We are not liable for situations where you are denied entry even after obtaining a valid visa, as such decisions are beyond our control. Similarly, we are not responsible for any customs, health, or immigration issues you face during travel.

7. Tour Packages and Travel Services Terms

For tour packages and any travel bookings made through Tripate:

  • 7.1 Inclusions and Itineraries: The inclusions/exclusions of each tour package (such as hotels, meals, sightseeing, transfers, guide services) will be as per the specific package details provided to you. All tour itineraries are tentative and subject to change for reasons such as local conditions, weather, strikes, government advisories, or operational considerations. We will make reasonable efforts to adhere to published itineraries, but no guarantee is made that itineraries will not deviate. We reserve the right to alter or omit any part of the itinerary, or to substitute venues or hotels, if we deem it necessary for the comfort, safety, or general well-being of the group, or due to circumstances beyond our control (force majeure). Any such change will not entitle you to any refund, but if a significant portion of the tour is canceled by us, we may provide equitable alternative arrangements or compensation as we determine appropriate.
  • 7.2 Agency for Third-Party Services: When a tour involves services provided by third parties (for example, airlines, transportation operators, hotels, cruise lines, or activity providers), the Company acts only as an agent arranging those services on your behalf. We exercise care in selecting reputable partners, but we do not own or control these third parties. All such bookings are subject to the terms and conditions of the respective service providers, which will be binding on you. For instance, airline tickets are subject to the airline’s conditions of carriage, and hotel stays are subject to the hotel’s policies. We are not liable for the acts, omissions, defaults, or negligence of any independent suppliers. If a third-party service cannot be delivered as promised (e.g. a flight cancellation or hotel overbooking), your remedy lies against that provider, and not against the Company. We will, however, provide reasonable assistance in coordinating with the supplier to help resolve any issues.
  • 7.3 Company’s Liability for Tours: For components of the tour that are directly operated by us (e.g., guided sightseeing by our tour manager), we accept responsibility for providing those services as described, subject to these T&C and applicable law. However, our liability is limited as described in Section 9 (Liability Limitation). We are not responsible for any loss or damage to personal property or any injury, illness, or accident during the tour except to the extent caused directly by our negligence. You partake in activities (such as water sports, adventure activities, etc.) at your own risk. We will not be liable for any delay or alteration in the tour program or expenses incurred due to circumstances beyond our reasonable control, including but not limited to acts of God, weather delays, government actions, strikes, war, quarantine, pandemics, or civil disturbances.
  • 7.4 Traveler Conduct: You are expected to conduct yourself in a proper manner and comply with the instructions of the tour leader or Company representative during a group tour. We reserve the right to remove any traveler from a tour if they are found to be causing distress, danger or annoyance to other travelers, or engaging in illegal or offensive behavior. No refund will be given for the unused portion of the tour in such cases, and we shall not be responsible for any costs incurred by the traveler as a result of termination.
  • 7.5 Health and Travel Documents: It is your responsibility to ensure you meet the health requirements (vaccinations, COVID-19 tests, etc.) and carry necessary travel documents (valid passport, visa, ID proof, insurance papers) for the tour. We will not be liable for any illness, delays or costs resulting from your failure to meet health or documentation requirements.

8. Cancellation, Amendment & Refund Policy

Note: The detailed Cancellation and Refund Policy is provided separately and is incorporated herein by reference. Below is a summary of key terms (for complete details, refer to our Cancellation/Refund Policy document):

  • 8.1 Visa Services: Once a visa application has been submitted to the embassy/consulate, the visa fee and our service fee are typically non-refundable. If you cancel your request before submission, we may refund the embassy fee (if not already paid to the embassy) but our service fee may be deducted as per policy. If a visa is refused by the authorities, fees paid are non-refundable since the decision rests with government authorities, not with us.
  • 8.2 Tour Packages: Cancellation of tour bookings by the customer is subject to cancellation charges which vary based on how far in advance the cancellation is made and the policies of the tour and third-party suppliers. Any eligible refunds will be processed after deducting applicable cancellation charges. If we cancel a tour before departure (for example, due to insufficient participants or force majeure), you will be offered an alternative or a full refund of money paid for the tour, as per our policy. Refunds, if any, for third-party ticketed components (flights, hotel bookings) will be as per the respective supplier’s terms. No refunds will be due for any unused services or portions of the tour if you leave a tour in progress or miss any services.
  • 8.3 Process for Refunds: Refunds, when approved, will be processed within the time frame stated in the Cancellation/Refund Policy. Typically, refunds are credited back to the original payment method. Please note that we cannot be responsible for the speed of refund credit once we have processed it, as bank processing times may vary. Any convenience fees or payment gateway charges originally paid are usually non-refundable. For more details, please review our Cancellation and Refund Policy.

9. Disclaimer of Warranties

All services on Tripate.com are provided on an “as is” and “as available” basis without any warranties, express or implied. To the fullest extent permitted by law, the Company disclaims all warranties, either express or implied, regarding the website and its services, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising out of course of dealing or usage of trade. We do not warrant that the content of our website (including pricing, descriptions, or other information) is complete, accurate, or up-to-date at all times. We also make no warranty that the operation of the website will be uninterrupted, error-free, secure, or that any defects will be corrected.

You understand and agree that any material or data downloaded or otherwise obtained through the use of our site or services is done at your own discretion and risk. The Company does not warranty or guarantee any travel products or services provided by third-party suppliers (such as airlines, hotels, transport operators), which are only arranged through our platform – those are subject to the warranties (if any) of the respective providers. No advice or information, whether oral or written, obtained from us shall create any warranty not expressly stated in these T&C.

10. Limitation of Liability

To make our position legally safe for the Company, we limit our liability to the maximum extent permitted by law:

  • 10.1 Consequential Damages Exclusion: In no event shall Taabow Travels Pvt. Ltd. or its directors, officers, employees, agents or affiliates be liable for any indirect, incidental, special, punitive, exemplary or consequential damages of any kind – including but not limited to loss of profits, loss of business, loss of goodwill, lost savings, or loss of data – arising out of or in connection with your use of (or inability to use) Tripate.com or any of our services, or any failure or delay in providing services, even if we have been advised of the possibility of such damages.
  • 10.2 Total Liability Cap: If, notwithstanding the above, the Company is found liable for any claim arising from or related to these services, our aggregate liability under such claims shall not exceed the amount you paid to us for the specific service in question. For example, for a visa processing service, our liability will not exceed the service fee you paid to us for that visa. This limitation applies to all causes of action in the aggregate, including breach of contract, breach of warranty, negligence, strict liability, misrepresentations, or any other tort or equitable theory.
  • 10.3 Not Liable for Visa Decisions & Travel Delays: The Company shall not be liable for any loss, expense, or damage resulting from a visa being denied or delayed by an embassy/consulate. This includes financial losses such as unused flight or hotel bookings, missed business opportunities, or any other impact of not obtaining a visa in time. We similarly are not liable for delays or disruptions in travel caused by third-party service providers (airlines, hotels, etc.) or force majeure events. Your recourse in such scenarios is as per the terms of the third-party provider or travel insurance if purchased.
  • 10.4 Third-Party Liability: As stated, many travel services we facilitate are provided by independent third parties. We do not have any control over their operations. Therefore, the Company is not liable for any personal injury, death, property damage, or other damages or expenses resulting from any act or omission of any third-party service provider (including any negligence or breach by the third party). Any claims arising out of those services must be brought against the responsible third party directly, and not against the Company. We can assist you in contacting the supplier, but we are not obliged to litigate or resolve disputes on your behalf.
  • 10.5 The limitations of liability outlined in this section apply to the fullest extent permitted by law. Certain consumer protection laws in India might not allow exclusion of certain warranties or limitation of certain damages; in such cases, to the extent those laws apply, our liability will be limited to the minimum extent permitted by law.

11. Indemnification

You agree to indemnify, defend and hold harmless Taabow Travels Pvt. Ltd., its parent, affiliates, and their respective directors, officers, employees, and agents (“Indemnified Parties”) from and against any and all claims, demands, causes of action, proceedings, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Tripate.com website or services; (b) any breach of these T&C or other guidelines/policies by you; (c) your violation of any law or rights of a third party; or (d) any act, omission, fault, or negligence by you or anyone acting on your behalf. This obligation will survive the termination of these Terms and Conditions.

(Explanation: This means if your actions or misuse of our services cause us to face legal claims or costs, you will cover those costs on our behalf, ensuring the Company is protected.)

12. Intellectual Property Rights

All content present on Tripate.com, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, software, and the compilation of the content, is the property of Taabow Travels Pvt. Ltd. or its content suppliers and is protected by applicable intellectual property laws. The trademarks, logos, and service marks displayed on the site (“Marks”) are registered or unregistered trademarks of the Company or third parties. Nothing in these T&C or on the website should be construed as granting, by implication or otherwise, any license or right to use any of the Marks without our prior written permission or that of the respective owners.

You agree not to infringe these rights or use the content of the site in any way that violates the intellectual property rights of the Company or others. Unauthorized use of the site’s materials (such as for commercial sale or creating derivative works) is strictly prohibited and may result in termination of your access to the site, as well as legal action.

13. Third-Party Sites and Links

Tripate.com may contain links to third-party websites or resources for your convenience (for example, links to government visa forms or travel insurance providers). These linked sites are not under our control, and we are not responsible for the content, features, offers, or privacy practices of any third-party websites. Inclusion of any link does not imply endorsement or association by the Company. If you access any third-party website through a link on our site, you do so at your own risk. The Company will not be liable for any loss or damage of any sort incurred as a result of your dealings with third parties or your use of third-party sites. We advise you to review the terms and policies of any third-party sites that you visit.

14. Modification of Terms

The Company reserves the right to change or update these Terms and Conditions at any time without prior notice. Such changes will be effective immediately upon posting on this page. We encourage you to periodically review the T&C to stay informed of any updates. Your continued use of Tripate.com following the posting of changes constitutes your acceptance of those changes. If you do not agree to the revised terms, you should discontinue using our services.

15. Governing Law and Jurisdiction

These Terms and Conditions and any disputes arising herefrom shall be governed by and construed in accordance with the laws of India. The courts of City/State], India shall have exclusive jurisdiction to hear and decide any dispute or controversy arising out of or relating to these T&C or your use of the services, subject to applicable law. You hereby consent to the jurisdiction of such courts. Notwithstanding the foregoing, the Company reserves the right to seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property or confidential information.

16. Grievance Redressal

In accordance with the Information Technology Act, 2000 and the rules made thereunder, the Company has designated a Grievance Officer for addressing complaints and grievances related to the Tripate.com platform.

17. Miscellaneous Provisions

  • 17.1 Entire Agreement: These T&C, along with any other policies or documents expressly referenced (such as the Privacy Policy and Cancellation/Refund Policy), constitute the entire agreement between you and the Company with respect to the subject matter hereof, and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and us. In case of a conflict between these T&C and any other specific terms (e.g., tour-specific terms provided at booking), the specific terms shall prevail to the extent of that conflict.
  • 17.2 Severability: If any provision of these T&C is found to be invalid or unenforceable under applicable law, that provision will be deemed severable from the remaining terms and will not affect the validity and enforceability of the remaining provisions.
  • 17.3 No Waiver: Our failure to enforce any right or provision of these T&C shall not constitute a waiver of such right or provision. Any waiver of any provision of these T&C will be effective only if in writing and signed by an authorized representative of the Company.
  • 17.4 Assignment: You may not assign or transfer your rights or obligations under these T&C to any third party. The Company may freely assign this agreement (and all rights and obligations hereunder) to any affiliate or in connection with a merger, acquisition, or sale of assets, or by operation of law.
